Like it or not, Ken Roy's statement is false.

He wrote ... " The OSHA laboratory standard (29 CFR 1910.1450) requires all employees working in laboratory settings (including special education teachers and paraprofessionals) to undergo safety training before they enter the lab."

This is plain and simply not true.. The lab standard does not and has never required this.

While I agree completely that OSHA regulations represent one layer of best practice and that failure to follow them can have all kinds of liability repercussions, this was not the point. The point is ... the statement if false. This is not an OSHA lab standard requirement.

Too many people mistakenly (or sometimes deliberately) suggest that OSHA standards require all employers to do x, y or z. It just ain't so for some public employers in some states. ... Jim

Students are not always adults, not being paid, and are by definition inexperienced and untrained. Juries usually have a lot of current and former parents of students in them. I smell toast.

However, truth be told, OSHA regulations are not accepted nationally as regulations in many public sector places of employment. There is a difference between Must and Should. We have a responsibility to make the difference clear between Regulatory Requirements and Best Practices.

Otherwise, we are heading down the slippery path of the ends justifying the means.

I reviewed the CHP of one pharmaceutical company that included the words Must and Should in their glossary. ... Jim
